NEW YORK CITY - Local Law 31
Effective August 9, 2020, Local Law 31 of 2020 states that an owner must use an Environmental Protection Agency (EPA) certified inspector or risk assessor, independent of the owner or any firm hired to perform lead-based paint remediation, to test for the presence of lead-based paint in a dwelling unit of a building built prior to 1960. The inspection must take place before August 9, 2025 or within one year if a child under the age of 6 comes to reside in the unit (whichever is sooner). This inspection must be conducted using an X-ray Florescence analyzer (XRF) with an approved performance characteristic sheet (PCS) at a testing action level of 1.0 mg/cm2 to be defined as paint that has a lead content measured at 0.5 mg/cm2 or greater as determined by laboratory analysis or an XRF instrument with an approved PCS and programmed at a testing action level of 0.5 mg/cm2.
NEW JERSEY - N.J.A.C 5:28A
Effective July 22, 2022, N.J.A.C. 5:28A will require lead-paint inspections & certificates for all pre-1978 rental properties in New Jersey prior to July 22, 2024 or tenant turnover, whichever occurs first.

Check your local municipality requirements for a “Lead Safe” certificate here via a Visual Inspection or Dust Wipes samples. “Lead Safe” certificates are valid for three years of inspection or tenant turnover, whichever occurs first.
